Where lien rights come from
Texas lien rights rest on the Texas Constitution, Article XVI, Section 37, and are implemented through Chapter 53 of the Texas Property Code, which sets out who may claim, what notices are due, and when.
Original vs. derivative claimants
Original contractors contract directly with the owner. Subcontractors and suppliers are derivative claimants and must send statutory notices (§53.056) to preserve rights.
Residential vs. commercial
Residential projects carry shorter notice and filing windows and additional content requirements. The affidavit must be filed by the deadline in §53.052 and contain the information required by §53.054.
Strict compliance
The affidavit and required notices must comply with the statute. The affidavit must also be served on the owner and original contractor under applicable Chapter 53 requirements.

How long do I have to file a mechanics lien in San Antonio, Texas?+
For commercial projects, the lien affidavit is generally due by the 15th day of the 4th month after the month work was last performed (3rd month for residential).
